    • Alcohol involvement was reported in 48% of the traffic crashes that resulted in pedestrian fatalities in 2009.

    • Drivers are required to yield the right-of-way to pedestrians crossing streets in marked or unmarked crosswalks in most situations.

    • Streets without sidewalks or crosswalks and other dangerous road conditions can increase the risk for a pedestrian accident.

  • Distracted Drivers- In 2008, a Florida man was awarded $1.5 million after being hit by a driver who was talking on his cell phone.
  • Poor Visibility- An 83-year-old New Yorker who was struck and killed by a Sheriff’s Office patrol car while crossing a busy street at night was awarded $83,500. The officer was speeding after a driver with broken tail lights, but failed to put on his lights or siren.
  • Drunk Driving- A West Virginia man was awarded $2.9 million for critical injuries he sustained after being struck by a drunk driver in 2008.
  • Failure to Yield the Right-of-Way- An elderly man was awarded $750,000.00 after being hit by a San Francisco Muni Bus. The victim was walking on the designated crosswalk when the bus took a right turn on red and struck him.
  • Poor Roadway Design- The family of a California woman who was struck and killed by a work truck while jogging was awarded $2.65 million. The company that employed the driver paid $2 million for the employee’s reckless driving and the county paid $650,000 for poor roadway design.
