Like all drug makers, the manufacturer of Actos, Takeda Pharmaceuticals, is required to provide an accurate representation of any adverse events to regulators through the FDA’s Adverse Event Reporting System.
The lawsuit claims that when Actos came under scrutiny for its serious side-effects, the company underreported cases of congestive heart failure to the FDA and asked its medical examiners to downplay the risks. The complainant says she was terminated for failing to comply with this order. The lawsuit also claims that the company downplayed the link between Actos and bladder cancer.
