Family of Veteran Sues California Care Facility Over Fatal Heatstroke

The family of ex-Marine Gene Rogers has filed a wrongful death and elder abuse lawsuit against Meadow Oaks of Roseville, blaming the facility for Rogers’ fatal heatstroke.
Information About the Lawsuit Against Meadow Oaks
According to the Miami Herald, the family placed the 83-year old Rogers in Meadow Oaks around December 2017 after the veteran was diagnosed with dementia. In June 2018, the family alleges that Rogers was left unattended on a patio in his wheelchair where he suffered fatal heatstroke.
The state of California investigated the incident and determined that Meadow Oaks should face a $1,000 fine. Unhappy with the results of the state investigation, the family decided to file a wrongful death suit against the facility.
The Family Accuses Meadow Oaks Neglect
The family claims that Rogers started off well at the facility but that he later began to show signs of neglect. Rogers’ hygiene began to decline, and the family caught staff leaving Rogers alone on the patio multiple times. According to the lawsuit, the family instructed the staff to avoid leaving Rogers outside unattended.
The family also accuses Meadow Oaks of dishonesty. Rogers’ son claims the family received conflicting reports about Rogers’ condition. Staff underplayed the severity of the heatstroke while the director of Meadow Oaks told the family that Rogers wheeled himself out onto the patio.
