Details of the Austin Electric Scooter Accident

According to the Austin American-Statesman, Austin-Travis County EMS responded to a call at the intersection of Chicon Street and Rosewood Avenue just before 1:45 am Saturday.

Early reports indicate that the man, who was in his 40s, sustained life-threatening injuries after falling from an electric scooter. The man was hospitalized in critical condition.

The details of the incident or how the man came to fall from the scooter were not immediately available.

Are Electric Scooters Dangerous?

In short, yes. Electric scooters like those produced by Bird, Lime, and Blue Duck can travel at speeds up to 15 miles per hour. Combine those speeds with limited rider protection, inexperienced operators, and risky rider behavior, and the potential for injury is considerable.

Some of the most common hazards associated with electric scooters are:

  • Reduced Visibility: Electric scooters are meant to be compact. While this is great for storing the scooters, it also means that motorists are less likely to see scooter riders. Riders can also easily be hidden from view by objects on and off the roadway.
  • Road Hazards: Scooters lack stability. As such, common road hazards like potholes, gravel, debris, and uneven surfaces can cause riders to lose control of their scooters and crash.
  • Rider Inexperience: A large percentage of electric scooter riders are operating the scooters for the first time. Even those who have used a Lime, Bird, or Blue Duck scooter are often unfamiliar with the traffic laws that they must abide by resulting in an increased risk of accidents.
  • High-Risk Behavior: While some riders may break traffic laws due to inexperience, other riders due so with reckless disregard. This includes riding on the sidewalk, riding against traffic, or rider while intoxicated.

Who Can Be Sued for an Electric Scooter Accident?

Who can be sued for an electric scooter accident is dependent on the type of accident that occurred and who was responsible for that accident. It is important to remember that there is no source of liability insurance when it comes to electric scooters, so legal action against the responsible party is often the only means of financial recovery.

Depending on the circumstances of your electric scooter accident, you may be able to seek compensation from:

  • The Rider: If your injures were the caused by a negligent or reckless scooter rider, then the rider can be held legally accountable for you injuries.
  • The Scooter Company: If a defect, design flaw, or malfunction contributed in any way to your accident and injuries, you can seek financial from the scooter’s manufacturer.
  • Motorists: If you injuries were the result of an accident caused by a negligent driver, you could seek compensation from the driver involved.
  • Pedestrian at Fault: If the actions of a pedestrian caused your accident – for example, they suddenly stepped into the path of a scooter rider – then you may be able hold the pedestrian accountable for your injuries.
  • The City: If a pothole or road defect caused your scooter accident, you may be able to seek financial recovery from the city.
