About the Boating Accident
In May of 2010, a boat struck the dredge pipe below the surface of Storm Lake, causing the boat's motor to flip into the boat. According to the Storm Lake Pilot Tribune, the boy was struck by the running motor and then later died from his injuries.
The boy’s family filed a lawsuit against the City of Storm Lake, the lake improvement Commission, Buena Vista County, three dredge operators, Brunswick Boats, and the driver of the boat.
After extensive fact-finding sessions, depositions, mediation and negotiation, the city’s insurer, EMC, reached a settlement with the plaintiffs.
Details of the Settlement
- The City of Storm Lake, the Lake Improvement Commission, and the county had to pay $800,000, but EMC will cover the city's portion.
- A $7,500 deductible was subtracted.
- Brunswick Boats and the boat driver are responsible for covering the remaining $400,000.
