Brooklyn Woman Awarded $62 Million in Medical Malpractice Lawsuit
A Brooklyn jury has awarded 33-year-old Stacy Gallete $62 million after determining malpractice during a gynecological procedure at Winthrop-University Hospital cost the young woman both of her legs.
Botched Gynecological Procedure Results in Amputations
According to Newsday, Galette, a former medical assistant, suffered a punctured colon during a procedure in October 2009, in which she underwent laparoscopic surgery remove an ectopic pregnancy.
Galette complained of severe abdominal pain after the surgery, but was discharged from the hospital only to return the next day after an infection had spread to her legs – three days later, both her legs were amputated below the knee.
It was determined that the puncture to her colon had resulted in blood poisoning and finally gangrene spreading through both her legs. Galette filed a lawsuit against Winthrop-University Hospital and three of the hospital’s doctors.
Jury Awards Galette $62 Million Verdict
According to the lawsuit, doctors originally attempted to curb the infection by amputating Galette’s feet before decided to amputate both legs below the knee. In addition, Galette was treated with potent antibiotics which caused her to lose some of her hearing.
While Winthrop-University Hospital argued that the amputations were necessary and saved Galette’s life, her attorney refuted their claim, stating the drastic measures would have never been necessary if not for negligence during Galette’s original operation.
The Brooklyn jury found in favor of Galette awarding her $20 million for past pain and suffering, $38 million for future pain and suffering and an additional $3 million for medical costs.
