Child Injured in New Mexico Accident

A New Mexico woman has been arrested following suspicions that she was drunk leading up the accident that left her 5-year-old passenger injured.

Child Injured in Possible Drunken Driving Crash

  • On October 10th, according to the Daily Times, a 5-year-old girl was injured as a result of an accident in downtown Farmington, New Mexico. 
  • Georgette Allen, a spokeswoman for the Farmington Police Department stated that the girl was taken to the University of New Mexico Hospital in Albuquerque for her injuries which were caused by not being properly restrained in the front seat and the airbag hitting the child in the face and also by the driver veering off the road. 
  • Danielle Martin, the mother and driver, has been arrested on charges of child abuse resulting in great bodily harm, great bodily harm by motor vehicle, and careless driving. 
  • The first two charges come with a first-degree felony and a third-degree felony if Martin is convicted. 
  • Martin is being held with a $70,350 bond and the Youth and Families Department of New Mexico has the child in their care and custody.

  • Suspicions of drunken driving arose when paramedics and police on the scene detected the smell of alcohol in addition to the driver’s BAC measuring at .16, when it was administered at the hospital in San Juan. 
  • The legal BAC limit for operating a vehicle in New Mexico is currently .08. 
  • According to the Century Council, 29.7 percent of total driving fatalities in New Mexico  involved a drunk driver in 2011 with 70 percent of those involving a driver with a BAC count above .15 percent.
  • However in Texas, the percentage of driving fatalities that involved a drunken driver is higher than New Mexico at 40.2 percent, with 1213 fatalities each year reported for 2011.
