Couple Awarded $11M in Garbage Truck Accident

A San Francisco garbage collector has been awarded $11.4 million for spinal injuries he sustained in a 2007 garbage truck accident caused by defective tire hubs. The driver was injured when one of the hubs used on the garbage truck fell apart, causing the front wheel to fall off and the truck to crash.

Details of the Product Liability Lawsuit

  • Three companies were involved in this case: Consolidated Mecto, Volvo Truck, and Wittke Manufacturing.
  • Plaintiff’s attorneys argued that the companies knew there were 15,000 to 25,000 defective hubs in service in trucks across the United States but failed to notify consumers.
  • Consolidated Metco was found 52% liable, Volvo was found 30% liable and Wittke Manufacturing was found 12% liable.
  • The jury awarded the plaintiff $2.4 million for past and future medical expenses and lost earning capacity, and $7.5 million for pain and suffering. His wife was awarded $1.5 million for loss of consortium.
