Couple Hit by Texting Driver Gets $500K

A married couple has settled for $500,000 after they each lost a leg due to an accident caused by a teenager texting while driving. The $500,000 is the maximum the insurance of the texting driver would pay.

Girlfriend Texted Driver Before Accident

According to the Daily Record, the driver was texting his girlfriend when he crossed into the lane of the couple. The teenager was driving his truck with his elbows when he hit the couple’s motorcycle, Mashable is reporting.

Despite the $500,000 settlement, the couple is not finished pursuing legal action. The couple’s attorney is trying to pursue legal action against the driver’s girlfriend, who texted the driver right before the crash. The attorney argued the girlfriend was “electronically present,” but the judge ruled that she could not be held civilly liable for the driver’s actions. The attorney is trying to get this ruling appealed.

The teenager was not prosecuted criminally for the accident, but he did plead guilty to using a cell phone while driving. His sentence included having to speak to several high schools about the dangers of texting while driving, as well as $775 in fines.
