According to the ABC News, 21-year-old Caroline Nicolai was killed in an alleged drunk driving accident while in police custody.

Drunk Driver Collides with Police Car

  • The accident occurred around 3:30 a.m. when a red Chevrolet Cobalt ran a red light, colliding with a police car.
  • According to police, the car slammed into the back left passenger door of the police car ejecting Nicolai who had been taken into custody shortly before.
  • The 21-year-old driver of the Cobalt, Nicole Moser admitted to police she had just left a bar with an unidentified passenger and admitted to being too drunk to drive.
  • Nicolai was taken to Ben Taub General Hospital where she was pronounced dead.
  • Moser has since been charged with intoxication manslaughter.

Woman in Custody not Properly Restrained

  • According to police, Nicolai had been taken into custody for her own safety after being found wandering Hobby Airport. She was en route to a sobering center when the collision occurred.
  • Preliminary investigations suggest that though Nicolai was handcuffed, she had not been secured in the vehicle with a seatbelt.
  • Police are required to seatbelt a person when they are taken into custody. The officer involved is still on duty pending investigations.
