Man Pleas Guilty in Fatal Pedestrian Accident

A resident of Kernersville has pleaded guilty in the death of a young boy who was hit by a car as he crossed the street to board a school bus.

Details of the Fatal Hit-and-Run

According to the Jacksonville Daily News, 11-year-old Hasani Wesley was killed on December 19th, 2012, in Winston-Salem, after a car struck him while he was crossing a road to get on a school bus

The man driving the car was Billy Roger Bailey. Originally Bailey was charged with involuntary manslaughter and passing a stopped school bus causing death; however, a mistrial was declared in April 2014 after new evidence revealed that the school bus driver may have not turned on her red lights and extended the stop arm before Bailey passed the bus.

Bailey pleaded guilty in court in Winston-Salem on Monday, June 23rd, 2014 to misdemeanor death by motor vehicle.

His sentence was 30 days in jail and 30 months of probation. Odina Wesley, Hasani’s mother, criticized prosecutors for allowing Bailey to serve a lesser sentence after the earlier mistrial.

Outraged by the decision, she was quoted saying “The decision of the District Attorney Jim O'Neill to allow Roger Bailey to plead to a misdemeanor sends a dangerous message that in Forsyth County, you can pass a stopped school bus and kill a child and get slapped on the wrist with a misdemeanor charge”.

The new evidence however changed the District attorney’s mind on the charge, despite the tragic accident.

Pedestrian Accident Statistics

Following information provided by the Pedestrian and Bicycle Information Center:

  • 4,743 pedestrians and 726 bicyclists were killed in traffic collisions in 2012. This averages to more than 12 pedestrian deaths every day.
  • 69 percent of all pedestrians fatalities recorded in 2012 were male.
  • Nearly 75 percent of all pedestrian fatalities occurred in urban areas.
  • 32 percent of all pedestrian fatalities occurred between 8:00 pm and 11:59 pm.
  • The average age of pedestrians killed in traffic crashes in 2012 was 46.
