News Report- Child Injured by Falling Gate
A 2-year-old boy and his baby sitter, 59, sustained injuries when a 16-foot wide security gate fell on top of them outside a cat clinic in Brooklyn, New York last Thursday (June 7, 2012).
Premises Liability Issues
- According to reports, since the gates are not technically part of the building, the Buildings Department does not “normally” inspect them.
- Nevertheless, investigators from the Department of Buildings issued a failure to maintain violation to the building owners.
- The two-year-old boy sustained a broken leg and remains in the hospital; the babysitter was treated in the hospital and released.
- This brings to mind another incident in May 2012 in Brooklyn in which a 12-year-old boy was killed after being crushed by an electronic roll-up gate.
