Parents Awarded $1.3M in Birth Injury Lawsuit
A New Jersey couple has been awarded more than $1.3 million in a medical malpractice lawsuit filed on behalf of their daughter who was permanently injured during a difficult delivery.
Details of the Birth Injury Case
In 2002, the couple’s child experienced a difficult delivery caused by shoulder dystocia. According to the plaintiffs, the physicians applied excessive pressure on the infant's head to release the shoulder. This caused severe damage to the child’s C5 and C6 nerves and resulted in permanent injury.
Jury Awards Family $1.3M
- The lawsuit alleged that physicians were negligent in applying excessive pressure to the infant’s head resulting in the rupturing of the C5 and C6 nerves.
- The lawsuit further alleged that the child endured serious injuries from the delivery, and currently suffers from limitations in movements, strength, muscle weakness, and arm-length discrepancy.
- The jury found the physicians liable and awarded the parents $1,340,000.00
