Study – Will Your Airbag Deploy?

A study released by the National Highway Traffic Safety Administration (NHTSA), examined a number of fatal accidents in which the car’s airbags did not deploy because the airbags were simply missing.

The study, released in 2008, examined an average of 51 accidents a year over a course of five years nationwide. Although the numbers are small, the concern is not the number of accidents per say, it’s the question of how many vehicles are still on the road without the proper safety equipment. Used car owners may be driving without properly installed airbags or may not have them at all.

The NHTSA never looked into further examination of the missing airbags, so consumers are unknowingly driving vehicles on the road without airbags.

NHTSA and Legislation

Recently, CA State Sen. Leland Yee (D-San Francisco) introduced a bill that would fine $5,000, up to a year in prison, or both for airbag fraud. The bill would hold repair shops accountable for airbag fraud whether or not an accident occurred.

Although the number of fatal accidents reported due to missing airbags is relatively low, there is still cause for concern. The NHTSA should have responded with an effort to increase standard inspection laws for used cars and hold used car lots accountable for any wrongful injuries or death due to missing airbags.

What Drivers Need to Know

Consumers aren’t aware that many used cars on the lot have not been inspected properly, have been salvaged and resold, but not necessarily inspected from bumper to bumper. Consumers looking into buying a used car should have an independent, expert mechanic check the airbags.
