Trucking Operation Shut Down for Serious Violations

According to a recent Federal Motor Carrier Safety Administration (FMCSA) news release, Ben Gordon Enterprises of Louisiana (d.b.a. Gordon's Tree Service) has been ordered to cease all transportation services due to “serious safety violations.”

Company Disregarded Out of Service Order

On October 15, 2007, Ben Gordon’s registration was revoked and an out of service order went into effect for the following violations:

  • Company did not participate in a scheduled New Entrant Safety Audit on September 22, 2007.
  • Several Roadside Inspections found that Ben Gordon Enterprises had drivers operating vehicles with suspended licenses or without any license at all.
  • Drivers did not possess medical examinations.

More Regulations Violated in 2012

A November 2012 comprehensive review of company operations found that Ben Gordon Enterprises had violated the following regulations:

  • Failed to implement an alcohol and controlled substance testing program.
  • Used drivers without CDLs.
  • Failed to maintain an accident register, reports, and driver qualification files.
  • Failed to keep records of inspections and vehicle maintenance.
  • Failed to require drivers to prepare vehicle inspection reports.
Company’s Transportation Services Shut Down

“FMCSA shut down Ben Gordon Enterprises after a thorough investigation found the company had willfully violated a federal out-of-service order, continued to operate vehicles in violation of that order, and continued to operate and direct the operation of its vehicles in willful disregard of critical safety regulations,” Federal Motor Carrier Safety Administration.
