U.S. Marshals Seize Food from Filthy Facility

Under orders from the U.S. Food and Drug Administration (FDA), U.S. Marshals seized food products from a Washington storage facility due to “widespread and active rodent and insect infestation in the facility’s warehouse and processing area.” After last month's inspection of Dominguez Foods' storage and processing facility yielded reports of insects and rodents near food, the FDA and U.S. Marshals issued a detention order, which eventually led to a federal seizure of affected food from the facility. 

Dead Rodents, Droppings, Insects Near Food

Last month, FDA investigators visited the Dominguez Foods food storage and processing facility in Zillah, Washington. During their inspection of the facility, FDA investigators reportedly found:

  • rodent droppings and urine stains on and around food products
  • rodent gnawed containers of food
  • a rodent nesting site
  • one dead rodent in the warehouse
  • live and dead insects in, on, and around food products

Food Detention and Seizure

After the investigation, the FDA issued a detention order pertaining to all food in the facility not in hermetically sealed containers. The administration then asked the U.S. District Court for the Eastern District of Washington to issue a warrant of arrest for the products, which led to the U.S. Marshals seizure of the contaminated food. 

FDA detention orders last for 30 days, during which time the administration can attempt to secure a warrant for seizure. This was the first time the FDA seized food under a detention order since the Food Safety and Modernization Act passed earlier this year.
