Drunk Drivers Create Unnecessary Dangers for other Motorists, Pedestrians, and Bicyclists

The law requires all drivers to exercise “reasonable care under the circumstances.” When someone does not use reasonable care, then their actions are considered negligent. Accordingly, when this negligence is exercised by a drunk or drugged driver, your life could be at risk. Every instance of death or injury caused by a drunk driver could be prevented.

The Centers for Disease Control and Prevention (CDC) reports that over 1.1 million drivers were arrested for driving under the influence of alcohol or narcotics in 2014. Frighteningly, this is only one percent of the 121 million self-reported episodes of alcohol-impaired driving among U.S. adults each year. The irresponsible and reckless actions of drunk drivers — excessive speeding, falling asleep, driving in the wrong direction — can lead to serious and oftentimes fatal injuries.

Drunk Driving Crash Statistics

Here are statistics regarding drunk driving in the United States in 2015, provided by the National Highway Traffic Safety Administration (NHTSA):

  • 10,265 people died in motor vehicle traffic crashes involving a drunk driver.
    • Drunk driving deaths account for 29 percent of all motor vehicle traffic deaths in the United States.
  • Every day, 28 people die in a drunk driving crash.
  • 16 percent of traffic fatalities among children age 14 and younger occurred in a drunk driving crash.
  • The annual cost of drunk driving crashes in the United States totaled more than $44 billion in 2015.
  • Drunk driving deaths by state:
    • Texas — 1,323
    • California — 914
    • Florida — 797
    • North Carolina — 411
    • Georgia — 366

Your Drunk Driving Accident Questions Answered

We have straight answers to difficult questions to help you make critical decisions, navigate legal process and help you get justice.

Following a drunk driving accident, there are always more questions than answers. At Thomas J. Henry, we’re here to answer any questions you have about your injury case.

The legal limit for driving a motor vehicle in Texas is 0.08 percent for drivers over 21. Blood Alcohol Content (BAC) level must be below this percentage.

BAC is the medical or legal measure of alcohol within a person’s bloodstream or on a person’s breath. It is measured by milligrams (mg) of alcohol per 100 milliliters (ml) of blood. A BAC of 0.10%, for example, means that an individual’s blood supply contains one part of alcohol for every 1,000 parts of blood.

Commercial drivers are only permitted to have a BAC of less than 0.04 in Texas. This applies to driving a commercial vehicle or a personal vehicle if you are classified legally as a commercial driver.

Texas has a history of ranking as the top state in the United States for alcohol-related traffic deaths.

According to the NHTSA (National Highway Traffic Safety Administration), around 1,468 Texans were killed in drunk driving crashes in 2017. Nationwide, one person dies every 48 minutes from alcohol-impaired crashes, according to 2017 statistics.

The damages you can claim after a drunk driving crash will depend on the circumstances of your accident and your injuries. Among the most common damages, however, are:

  • Pain and suffering
  • Mental anguish
  • Loss of consortium
  • Disfigurement
  • Physical impairment
  • Past and future medical costs
  • Lost wages

DWI stands for driving while intoxicated while DUI is driving under the influence. DUI’s are issued to minors under 21 only in Texas. DWI’s are more severe in penalty within the state of Texas. Some states do not distinguish between the two or use both.
