Missouri Dad Files Lawsuit After Crash Killed 3 of His Children

A southern Missouri father has filed a wrongful death lawsuit after losing three of his children in a traffic accident last July.

Details of the Wrongful Death Claim

ABC News reports Ionel Dobos filed a lawsuit this month alleging that the driver of a tractor-trailer failed to signal when re-entering Interstate 44 after having been parked beside the road near Springfield.

The suit also claims that Claudia Dobos, the mother of Ionel Dobos’s children, was negligent and speeding when her van struck the front of the rig. The impact of the crash ejected three of their children through a hole in the side of the vehicle, killing them. Five of their other children also in the van were injured.

The lawsuit also names companies in charge of employing and supervising the truck’s driver, alleging that the trucker had violated rules that prohibited him from driving more than 70 hours in an eight-day period and eight-straight hours in a day.

No criminal charges were filed in the crash. The report did not explain the status of Claudia and Ionel Dobos’s relationship.

When to File a Wrongful Death Lawsuit

Individuals can file a wrongful death lawsuit to recover compensation for deaths caused by another person’s negligence or unlawful violence. To win a wrongful death claim, beneficiaries must provide proof that the death was caused by negligence and that the death caused them substantial suffering.

Among the damages a family can seek in a wrongful death lawsuit are:

  • Loss of quality of life
  • Loss of love and emotional support
  • Loss of financial support
  • Loss of companionship
  • Loss of society

Under Texas law, a wrongful death claim can only be filed by spouses, children, and parents.
