Tow Truck Driver Charged in Harris County Crash that Killed Baby

A tow truck driver was arrested and charged with vehicular manslaughter following a tragic truck accident in northwest Harris County.

Tow Truck Driver in Fatal Harris County Crash Had Previous Record

News 4 San Antonio reports the crash occurred around 10:15 am Sunday in the 6600 block of Cunningham, near the intersection with West Little York Road.

Early reports state a Nissan sedan was stopped at a stoplight when it was struck by the tow truck. The baby and his mother were rushed to the hospital, but the baby did not survive. Reports indicate he was four to seven months old.

The condition of the mother was not immediately available.

The driver of the tow truck, 39-year-old Jose Luna, remained at the scene and was taken into police custody. The district attorney’s office suspects Luna was speeding prior to the crash and said there were no indications that Luna tried to apply his vehicle’s brakes before the collision.

Luna is currently charged with vehicular manslaughter. Luna has a prior record, having previously been sentenced to five years for sexual assault of a child in 2004 and to six months for a drug charge in 2011.

The tow truck accident remains under investigation.
