Lawsuit Blames Window Tint for Fatal Pedestrian Accident

A lawsuit blaming vehicle window tint for a pedestrian accident that killed a young jogger has been filed in the Supreme Court of the State of New York.

About the Fatal Pedestrian Car Accident

The lawsuit was filed in connection with a fatal pedestrian accident that resulted in the death of a 15-year-old jogger in November 2014.

While a police report indicted that the window tint was not a factor in the accident, Elvia Daniels, the mother of Jenna Daniels, has filed a civil complaint against the driver, Jason Hills, and the window tint installation company that has yet to be identified.

Daniels claims that at the time of the crash, Hills was operating a car with tinted windows that prevented safe operations violating various laws. Daniels also believes that the window tint company that installed the tint was fully aware that the product would render unsafe automobile operations due to the contribution of dark tint.

Hills and the tint shop have both been summoned, and the Plaintiff’s representation is requesting various documents, files, and references concerning the window tint and its instillation to the vehicle.

Pedestrian Accident Statistics

The following information was provided by the U.S. Centers for Disease Control and Prevention (CDC):

  • 4,743 people were killed in pedestrian accidents in 2012 – an average of one pedestrian death every two hours.
  • An additional 76,000 pedestrians were injured in traffic accidents in 2012.
  • Roughly 20 percent of children between the ages of 5 and 15 who were killed in traffic incidents in 2012 were pedestrians.
  • 48 percent of fatal pedestrian accidents involved a driver or pedestrian that was under the influence of alcohol.
