Toxic Baby Food Lawsuits

Serving Clients Nationwide From Our Texas Offices in Corpus Christi, San Antonio, Austin, and Dallas

Thomas J. Henry is actively investigating claims of children developing autism and ADHD after being exposed to dangerously high levels of heavy metals in popular baby food products.

Multiple toxic baby food lawsuits have been filed alleging manufacturers of popular baby foods like Gerber, Beech-Nut, and Walmart knowingly sold baby food containing metals like arsenic, lead, cadmium, and mercury. The toxic baby product lawsuits further allege the presence of the toxins resulted in children developing neurodevelopmental disorders, including autism spectrum disorder (ASD) and attention-deficit/hyperactivity disorder (ADHD).

Popular Baby Foods Contain “Dangerously High Levels” of Toxic Heavy Metals

The revelation that some of the most popular baby food products in the United States contain dangerous toxins was the subject of a 2020 report by a U.S. Congressional Subcommittee. A second report issued in 2021 supported these findings.

According to the subcommittee, “dangerously high levels” of arsenic, mercury, lead, and cadmium were found in various baby food products, including infant rice cereal, teething biscuits, purees, rice cakes, and others. Among companies believed to be producing tainted baby foods are:

  • Beech-Nut
  • Gerber
  • Hain Celestial Group – Earth’s Best Organic
  • Nurture – Happy Family Organics and Happy BABY
  • Plum Organics
  • Sprout Foods – Sprout Organic Food
  • Walmart – Parent’s Choice

The report also stated that the companies knew of the presence of harmful heavy metals in the baby food, but sold the products nonetheless.

Details of the Toxic Baby Food Report Findings

The U.S. Food and Drug Administration and Environmental Protection Agency (EPA) have strict guidelines on the presence of heavy metals in food and beverages. For example, bottled drinking water is only allowed to contain up to:

  • 10 parts per billion (ppb) of inorganic arsenic
  • 5 ppb of cadmium
  • 5 ppb of lead
  • 2 ppb of mercury

The subcommittee report found levels of each of these toxins far in excess of the allowed amounts. This includes levels:

  • Up to 91 times more than the level of arsenic deemed acceptable for adults
  • Up to 69 times more than the level of cadmium deemed acceptable for adults
  • Up to 177 times more than the level of lead deemed acceptable for adults
  • Up to 5 times more than the level of mercury deemed acceptable for adults

Surprisingly, these findings were pulled from the companies’ own testing and documents, meaning the companies were well aware their products were tainted and dangerous.

A tort is a civil wrongful act committed by a person or company that results in harm to another person. A mass tort is when multiple victims are injured by the same single tort.
A court will consider if a mass tort lawsuit is permissible by determining:
  • whether a large number of plaintiffs are involved
  • whether the plaintiffs are located near or far from each other;
  • whether the injuries sustained are similar among the plaintiffs;
  • whether the claims arose from the same cause (defective toy, car part, oil spill, etc.)
  • Defective products, such as car parts, toys, or other consumer goods.
  • Pharmaceutical drugs, such as those that are later linked to severe or fatal health consequences
  • Environmental hazards, such as polluted water sources contaminated by nearby industrial sites or an oil leak.
Thousands of lawsuits across the country may be filed with a mass tort. These lawsuits are filed in numerous federal district courts. In a mass tort, federal judges will consolidate the thousands of lawsuits into a single proceeding. One judge in a single federal district court will oversee litigation, allowing for consistent rulings and a more expeditious process for the plaintiffs.
In a mass tort, each plaintiff (injured person) has an individual claim resulting from their unique damages. In a class action, many plaintiffs are considered collectively. Similarly, in a mass tort, each individual's claim "value" is unique to the severity of their injuries. In a class action, plaintiffs generally suffer injuries of similar severity, resulting in the same amount of compensation value.
