The accident took place around 5:00 a.m. at the intersection of Saratoga and Weber. According to Corpus Christi police, a man was crossing the street when the light turned green and a vehicle traveling east of Saratoga Boulevard struck him. The man was not using a crosswalk.
Police said the driver dialed 911 and remained at the scene of the accident until the victim was taken to a local hospital with serious injuries.
Investigations are ongoing.
According to Texas Transportation Code Sec. 552.005, pedestrians in Texas must yield right-of-way to other vehicles if crossing the road outside of a marked crosswalk. This, however, does not mean that pedestrians cannot recover compensation for car accident injuries incurred while jaywalking.
Because Texas follows a system of modified comparative negligence, pedestrians can still file a claim after an accident if the driver is deemed 50 percent responsible. Drivers who were distracted, acting negligently, or breaking the law are still at fault for an accident even if the pedestrian was jaywalking.
