Treadmill Accident Victim Receives $85K

A 55-year-old Texas woman who was injured by a malfunctioning treadmill in a Dallas hotel gym recently received an $85,000 settlement for her injuries. The plaintiff suffered two fractured scapulas (shoulder blades) when the treadmill she was running on malfunctioned.

Details of the Premises Liability Case

  • The plaintiff was staying at the Extended Stay Deluxe in Dallas in 2010 when the treadmill accident occurred.
  • She was using a treadmill at the hotel gym when it began to speed up uncontrollably. She claims that the emergency stop safety cord failed to stop the belt.
  • The woman was thrown from the treadmill and broke both her right and left shoulder blades. She claimed that her injuries, which caused her to be hospitalized for a month, left her partially disabled.
  • The woman sued HVM LLC, the owner of the hotel, for premises liability; plaintiff’s attorneys claimed that the equipment malfunction was caused by poor maintenance.

Dallas Jury Awards Plaintiff $85,000

The woman and her husband sought damages for past and future pain and suffering, physical impairment, medical expenses, and loss of consortium. The case was settled prior to trial for $85,000.
